Abstract

This study discusses "The Green Constitution Paradigm: Assessing the Effectiveness of the Constitution in Ensuring the Right to a Healthy Environment." The background of this research stems from the increasing environmental crisis that threatens human rights, especially the right to a healthy environment. The aim of the study is to explore how the principles of the Green Constitution can be integrated into existing legal frameworks and to assess their effectiveness in protecting this right. The methodology used is a qualitative approach with case studies, in-depth interviews, and analysis of relevant legal documents. The findings indicate that despite challenges in implementing the Green Constitution, its principles can enhance environmental protection through community participation and strengthened regulations. The study concludes that successful implementation of the Green Constitution requires collaboration among the government, civil society, and academia. Recommendations include the need for legal education on environmental rights and strengthening public participation mechanisms in environmental decision-making processes.
