IMPLEMENTATION OF RI LAW NUMBER 11 IN 2022 CONCERNING INTERNAL SPORTS RESOLUTION OF INTER-ATHLETE MUTATION DISPUTES REGIONAL (STUDY IN PANGKALPINANG CITY)

Abstract

In this research, the author discusses the implementation of Republic of Indonesia Law Number 11 of 2022 concerning Sports in Resolving Inter-Regional Athlete Transfer Disputes (Case Study in Pangkalpinang City). There is legal ambiguity in Article 102 of the Sports Law which does not yet specifically regulate the definition, types and further authority for each parent sport branch to resolve sports disputes which in the final way of sports disputes (the final way) through the sports arbitration body causes uncertainty. law in society, in particular. to sports industry players if there is a sports dispute that needs to be resolved quickly, effectively and fairly. Based on the above, this research thesis raises the problem formulation: (1) What is the legal construction in resolving athlete transfer disputes between regions (study in Pangkalpinang City)? (2) How is the implementation of Republic of Indonesia Law Number 11 of 2022 concerning Sports in resolving athlete transfer disputes between regions (study in Pangkalpinang City)? This thesis research is empirical juridical research using a statutory approach and an empirical approach. The primary, secondary and tertiary legal materials obtained by the author will be analyzed using grammatical interpretation, systematic interpretation and sociological interpretation analysis techniques. From the research method above, the legal construction in resolving inter-regional athlete transfer disputes (study in Pangkalpinang City) refers to Law Number 11 of 2022 and the Decree of the General Chairman of KONI Number 4 of 2012. So that every athlete transfer request can be rejected if it is detrimental to interests in developing sports in the area of origin. Implementation of Republic of Indonesia Law Number 11 of 2022 concerning Sports in resolving athlete transfer disputes between regions (study in Pangkalpinang City). There are several factors for athlete transfers, divided into 3, namely internal factors, external factors and other factors. In fact, it has gone through appropriate procedures and has been regulated in Government Regulation Number 16 of 2007 as follows. Sports Law Number 11 of 2022 Article 63 concerning the Implementation of Sports which states that, for the transfer of sportsmen as referred to in article 58 paragraph (1), the sportsman's destination association/club provides compensation to the sportsman's origin association/club in accordance with the provisions of the parent sports organization.
